Terms of Use and Sale

These General Terms ("Terms") govern access to and use of the Genielo platform ("the Service"), available at genielo.com, published by Hamza Labyad, a natural person acting in his own name (see our Legal Notice). By creating an account or using the Service, you fully accept these Terms.

1. Purpose

Genielo is an artificial intelligence platform that generates text, images, voice and video from instructions provided by the user, as part of a subscription or a purchase of credits.

2. User Account

Creating an account requires a valid e-mail address and a password. You are responsible for keeping your credentials confidential and for any activity carried out from your account. The Service is reserved for persons aged at least 18.

3. Subscriptions, Prices and Payment

Prices are shown in euros (€), including any applicable taxes.
Payments are processed by Whop, the official reseller ("merchant of record"), which handles invoicing and the collection of applicable taxes (including VAT where relevant). As the publisher is not registered for VAT in his own name, no VAT is charged directly by Genielo.
Subscriptions renew automatically at each term (monthly or annual) at the prevailing rate, unless cancelled before renewal.
You may cancel at any time; cancellation takes effect at the end of the current period and no pro-rata refund is due, unless mandatory law provides otherwise.

4. Right of Withdrawal

In accordance with European Union consumer law, consumers generally have a 14-day withdrawal period. However, for digital content supplied immediately, by starting to use the Service you acknowledge and agree to immediate supply and the loss of the right of withdrawal for the portion already consumed.

5. Credits

Using the AI features consumes credits according to the subscribed plan. Credits are valid according to the plan's terms and are not convertible into money.

6. Acceptable Use

You agree not to use the Service to:

generate unlawful, defamatory, hateful or violent content, or pornographic content involving minors;
infringe the intellectual property rights of third parties;
impersonate others or create deceptive content (disinformation, malicious deepfakes);
attempt to circumvent security measures or overload the infrastructure.

Any breach may result in the suspension or deletion of the account without refund.

7. Ownership of Generated Content

Subject to payment of your subscription and compliance with these Terms, you own the rights to the content you generate. You are solely responsible for how you use it. You acknowledge that similar content may be generated for other users.

8. Nature of AI and Limitation of Liability

Content is generated automatically and may contain errors or inaccuracies. The Service is provided "as is", without guarantee of results. To the extent permitted by law, the publisher's liability is limited to the amount paid by the user over the last 12 months.

9. Availability

We strive to ensure the availability of the Service but do not guarantee uninterrupted operation. Interruptions for maintenance or technical reasons may occur.

10. Personal Data

The processing of your personal data is described in our Privacy Policy, and the use of cookies in our Cookie Policy. These documents form an integral part of these Terms.

11. Changes to the Terms

We may amend these Terms. Changes take effect upon publication. By continuing to use the Service, you accept the updated Terms.

12. Governing Law and Disputes

These Terms are governed by Moroccan law, without prejudice to the mandatory consumer protection provisions of your country of residence within the European Union. EU consumers may use the European online dispute resolution platform: ec.europa.eu/consumers/odr.
